We, representatives of civil society in Belarus, turn to the Supreme Court as the last resort in matters of electoral complaints.
Article 112 of the Constitution prescribes that the courts administer justice on the basis of the Constitution and other normative acts adopted in accordance with it.
In accordance with Art. 60 of the Constitution of the Republic of Belarus, the protection of the rights and freedoms is guaranteed to everyone by a competent, independent and impartial court within the time limits specified by law.
According to Art. 2 of the International Covenant on Civil and Political Rights, ratified by the Republic of Belarus and comprising part of the current legislation, each State Party to the present Covenant undertakes:
(a) To ensure that any person whose rights or freedoms as herein recognized are violated shall have an effective remedy, notwithstanding that the violation has been committed by persons acting in an official capacity;
(b) To ensure that any person claiming such a remedy shall have his right thereto determined by competent judicial, administrative or legislative authorities, or by any other competent authority provided for by the legal system of the State, and to develop the possibilities of judicial remedy;
The Supreme Court either already has received or will soon receive complaints from presidential candidates against the CEC decision on the final election results. In accordance with the Constitution, these complaints must be accepted for consideration.
We rely on the impartiality, independence and competence of the Supreme Court. By accepting complaints for consideration, you will give hope to the Belarusian people for a legal resolution of the existing disagreements in this difficult time.
